Chavez, Jr-Jacobs fight fate to be decided at hearing Tuesday

The Julio Cesar Chavez, Jr.’s lawsuit against the Nevada Athletic Commission will come to a head when the parties argue over Chavez, Jr.’s request for a Temporary Restraining Order and Preliminary Injunction from his suspension.  If the Court approves of the TRO, JCC will be clear to fight this Friday in Arizona against Daniel Jacobs.

Chavez, Jr. filed the lawsuit seeking relief from the NAC’s ruling that his declining of a drug test amounted to a failure by the commission.  Chavez, Jr. argues that he was not a licensed boxer under the jurisdiction of the commission.  He had requested a hearing on his temporary injunction so that he could fight in Arizona.  However, prior to the hearing, the Nevada Athletic Commission filed a “Notice of Removal” to Federal Court.  The removal is an automatic move to federal court from state court based on a federal issue that was filed in the Complaint.  That federal issue was the allegation of a violation of Chavez, Jr.’s due process rights.   Since then, the parties have agreed to “remand” the case back to Clark County so long as Chavez, Jr. amended his lawsuit.  He has, but now time is of the essence with the hearing.

It appears that the State of Arizona is interested with the outcome as they will discuss the results at its monthly hearing on Wednesday.  JCC’s atttorney attached an email correspondence from Arizona Department of Gaming’s Executive Director which requests a copy of the Judge’s ruling “as soon as possible.”

Payout Perspective:

The Nevada Athletic Commission is opposing the TRO and Preliminary Injunction at the hearing which makes tomorrow’s decision up in the air.  The TRO is just that, “temporary” until a “show cause” hearing can be set down the road.  In this case, I would suspect that with the looming damage of the cancellation of this event on Friday, that the Court will grant this TRO which will spare fans, the state of Arizona and the fighters from losing out on a payday.  MMA Payout will keep you posted.

I should point out that according to those at TKO that the ESPN/MVPW boxing deal is a revenue sharing agreement similar to the original AEW/Turner deal in 2019 and not a full paying media rights deal which Top Rank had and wasn't renewed.
