Plaintiffs file Reply Brief in White House lawsuit

With a close deadline approaching, the plaintiffs filed a Reply Brief late last night in response to the government’s opposition to an injunction which would prevent the UFC White House event from happening Sunday night. Notably, the Judge in the case has determined to make a decision based on the briefs, not needing oral argument.

Two citizens filed the lawsuit on Monday alleging that the National Park Service, a branch of the U.S. Government controlling the Lincoln Memorial and White House did not follow protocol. In addition, they allege that the makings of the event reflects corruption on the part of the government administrators and the UFC. It points out that the venture is for-profit with the UFC and that it is obtaining valuable publicity from the event. Additionally, for those wanting to watch it must subscribe to Paramount+ as it will not be on free network television.

The government opposed the briefing citing precedent that there have been sporting events on the grounds of the White House. While it is true, those events were not-for-profit. Notwithstanding this seemingly blaring difference, the government continued with its attack on the motion.

In addition, the government claims that it could not satisfy its burden of showing a need for injunctive relief. They argue that the plaintiffs brought the lawsuit too late citing that based on a balance of harms, the government would be hurt more due to the amount of money it has expended, the fact that athletes are cutting weight, etc. The government also argues substantial reliance on the event contending that they has been extensive planning and cost into the event.

On Wednesday night, the plaintiffs filed a reply brief in response.

In its reply brief, the plaintiffs reiterated its stance that the National Park Service had not followed protocol and were exploiting public landmarks for private profit.

They point out that the “claw” had not been visible until late last week and that in the press, the president indicated that it may stay. Thus, this may fly in the face of the government argument that the claw is a temporary structure that is excluded from the governmental statutes and oversight.

The plaintiffs also reiterate that their standing based on the aesthetic and dignitary harms that would occur for the for-profit nature that will be received by TKO.

Certainly, the reason for the lawsuit is due to extraordinary nature of the event and the fact that it is for the profit of one of the president’s allies. TKO negotiated a lucrative media deal with Paramount-Skydance last August which benefited the company. But a month prior the U.S. government allowed a merger allowing Paramount to merge with Skydance Media. In addition, TKO is lobbying for the Muhammad Ali Boxing Revival Act which would allow for Zuffa Boxing to act as its own promoter and regulatory body.

Based on this late date, its unlikely that there will be an injunction preventing the UFC White House event, although the weather may be the last obstacle. Nevertheless, the lawsuit is a reminder that there is blatant corruption that might be occurring before our eyes.
