Chris Jericho has filed a trademark with the USPTO for his Painmaker gimmick. The last time Jericho used the gimmick was against Nick Gage in AEW this past July.
The application was filed December 6th.
The description of the mark states that it, “consists of a full figure design of a character comprising a fedora, a leather jacket having spikes protruding therefrom, a scarf, and a painted face.
The owner of the mark is Chris Irvine, Inc. (Jericho’s real surname). He identifies several categories in which he plans to use the Painmaker mark.
It is identified to be used in the future for “Downloadable image files containing trading cards, artwork, photos, or memes authenticated by non-fungible tokens (NFTs); Downloadable multimedia file containing artwork, text, audio, and video relating to trading cards, artwork, photos, or memes authenticated by non-fungible tokens (NFTs)”
It is also identified to be used for hats, shirts, bandanas, sweatshirts and hooded sweatshirts.
He also identified the use of “Entertainment in the nature of wrestling contests.” He identifies this good and/or service as being used as early as June 2018.
Payout Perspective:
You may recall Jericho using this gimmick in Japan and then his latest use was this past summer. It looks like when he plans to return to the wrestling ring he will use the gimmick to sell merchandise which it appears will include NFTs. This is a good move for Jericho as he has developed a character and his identifiable mark should distinguish from others as well as protect his look from others. Its relatively new for professional wrestlers to protect their brand but it’s a smart thing to do to ensure that they can commercially take advantage of something they have developed and protect it from those that may pirate the look or gimmick.
