In addition to the Misha Cirkunov lawsuit, the same attorneys involved in the Le, Johnson and Cirkunov cases filed a case on behalf of Phil Davis. The difference with Davis’ lawsuit is that he requests a change to the landscape of future MMA contracts.
Instead of monetary damages which is the primary reason for the filing of the 3 other lawsuits, Davis lawsuit focuses on eliminating restrictive terms in MMA contracts. This targets clauses like the Champions Clause. Ideally, Davis is fighting for MMA contracts with a duration length of one year.
This past October, Zuffa filed a Motion to Dismiss the lawsuit claiming it had no merit. One of the reasons it cites is the claim that Davis’ claims were extinguished as part of the Le settlement. However, Davis states that his claims “arose before the final settlement of the lawsuit.”


As of the date of this writing, the motion remains pending. Davis’ attorneys have a requested oral argument but as of this writing we don’t know if that is going to happen. The arguments primarily stand upon whether Davis can bring the lawsuit and whether he has a recognizable damage. The lawsuit is based on injunctive relief which differs from monetary damages. This lawsuit will be based on legal precedent as the parties make persuasive arguments about cases related to whether this case can be brought after the Le settlement and if Davis’ injuries are legally recognizable.
