The Oliver Luck-Vince McMahon lawsuit continues with a discovery dispute over the iphone the former XFL commissioner used. In addition, Luck objects to several of McMahon’s responses.
Luck requests documents that relate to his performance while XFL Commissioner which include bad and good issues. Luck contends that the production of communications was limited to alleged poor performance.
McMahon contends that Luck is withholding the passcode for his company-issued cell phone. This has been one of the major bones of contention between the parties as McMahon states that Luck had indicated he would provide the phone and then backed off those comments. Moreover, there are claims by McMahon that he used the phone for non-company business and deleted texts and pictures which they claim may be a ‘spoilation of evidence’ issue as they claim Luck destroyed evidence.
McMahon also asserts that Luck left his post as commissioner in March and was unavailable for business even through phone calls or other means at a time when the league was teetering on dissolving.
The parties met to discuss these outstanding discovery issues as the two sides return to litigating the matter after Alpha Entertainment was resurrected out of Chapter 11 bankruptcy by a group consisting of The Rock and his business partner (ex-wife) Dany Garcia.
Payout Perspective:
We’ll have more on this issue as the litigation continues but its setting up to be a contentious lawsuit between the two parties. At issue is the remaining salary on Oliver Luck’s contract as XFL commissioner. McMahon claims that despite a personal guaranty from him, Luck was terminated for cause. The iphone issue may be one of the bigger sticking points between the parties as McMahon believes there to be some sort of damning information on Luck’s phone while Luck makes the case that McMahon is attempting to use the termination as a way out of his contractual obligation.
