Canelo lawsuit dismissed for failure to properly assert jurisdiction

The Canelo Alvarez lawsuit has been dismissed.  But don’t worry, the court has granted Alvarez the chance to amend his lawsuit against Golden Boy, DAZN and Oscar De La Hoya.

On Friday, the Court issued an order dismissing the lawsuit for failing to show that it had jurisdiction over the parties.  The Court explains:

“Because the Complaint alleges the citizenship of the LLC defendants as if they were corporations, rather than as limited liability companies, the Complaint has not properly alleged the citizenship of those parties.”

Essentially, Alvarez’s lawyer described the defendants as a corporation whereas they are actually limited liability companies/corporations (LLCs).  Identifying the jurisdiction of each member of each LLC to establish diversity jurisdiction.  A requisite to litigating in federal court is diversity jurisdiction which requires that the “controversy exceeds $75,000” and the parties are “diverse” in terms citizenship or in this case the state of incorporation. 

The problem here is that Alvarez’ attorneys need to identify the members of the LLC for Golden Boy and DAZN as to where they are located and to establish that they are from different states to perfect the diversity requirement.

Alvarez is invited to re-file the Complaint per the Order.

Payout Perspective:

Clearly an easily rectified issue although it burns credibility on the party of the attorneys for Alvarez in this case as a minor faux pas can be seen as a glaring indication of inability to litigate correctly.  Certainly, DAZN and GB have picked up on this error.  Also omitted from the original complaint is the Contracts which Canelo is suing over.  MPO will continue to follow.
