The Legal Submission: Episode 2 Luck v. McMahon

Oliver Luck has filed a lawsuit against Vince McMahon based on a breach of contract of his Employment Agreement with the XFL.

I discuss the contents of the lawsuit and the impact that McMahon’s Alpha Entertainment may have over Luck’s claim which was filed after the XFL filed for Chapter 11 Bankruptcy.

Luck claims that a letter sent by McMahon’s lawyers which effectively terminated his employment as commissioner was a pretext so that Alpha Entertainment would be relieved of his duties and effectively the league would not have to pay out on his contract. 

In the company’s bankruptcy filing, Alpha filed a motion with the court to reject certain executive contracts entered into which includes Luck’s.

McMahon’s lawyer disputes the lawsuit filed by Luck.  Luck explicitly indicates that it is not looking to sue Alpha Entertainment, LLC since they are in bankruptcy. But, one might believe that McMahon will deny Luck’s lawsuit claiming that Alpha should be the proper entity to sue. And since Alpha is in bankruptcy, Luck cannot proceed with the lawsuit until the resolution of the proceeds of Alpha.

As discussed in the audio, Luck is not listed as one of the creditor’s in Alpha’s filing. Notably, a couple coaches are listed which would indicate that they will be compensated after liquidation.
