John Ourand of the Sports Business Daily/Journal has followed up a report on the Fox-Direct TV contract dispute. The two parties have now drawn lines in the sand which has Direct TV threatening to pull Fox channels on November 1.
Late Thursday night Fox released the following statement (obtained via John Ourand’s twitter)
Despite Fox Networks’ offer of an extension during our ongoing negotiations, DirecTV has informed us and their customers that unless we agree to their demands, they “will suspend our networks on November 1.”
DirecTV sent us a proposal on Tuesday afternoon. They have given us no chance to respond before taking an unnecessarily aggressive posture and going public. It is disappointing that they have chosen bad faith tactics over meaningful negotiation.
We have proposed to keep the Fox Networks on DirecTV for the same price, and on the same terms as they are currently carried while we attempt to work out a fair agreement. Unfortunately, DirecTV has decided that unless they get their way, they are going to pull the plug on their customers November 1.
The following is Direct TV’s response (via Ourand’s twitter):
After months of making little progress in our talks with News Corp and Fox to renew our agreement to carry their regional sports networks and other national channels we’ve regrettably reached a point where we will be forced to suspend the channels as soon as Nov. 1 unless News Corp is willing to move toward a more reasonable price increase.
They are currently asking our customers to pay 40% more for the exact same Fox channels that they already receive and that’s simply unfair and unwarranted. We hope to resolve this situation before any action is taken, but we will do what’s necessary to protect our customers from excessive and unwarranted fee increases. We already provide News Corp nearly a billion dollars a year for their channels, and we have no problem continuing to compensate them fairly.
Note: Fox broadcast stations and Fox News are not affected at this time
Fox contract ends December 31, 2011 while Fox News contract ends January 31, 2012.
Payout Perspective:
Fortunately for the UFC, the Fox network will not be affected for its big “UFC on Fox” event November 12th. However, the dispute could affect its future programming on Fox networks. Why? Direct TV has 19 million subscribers and is the second biggest distributor in the US. A prolonged dispute between Fox-Direct TV could negate UFC momentum of promoting its brand on Fox networks. With UFC programming set for Fox cable networks like FX and Fuel, many of the casual viewers will not see the UFC with its new network partners. In fact, the dispute could be beneficial to Spike TV which could go heavy into airing the UFC library during this time. As we’ve pointed out, this could lead to future viewer confusion once Fox-Direct TV come to terms. We will continue to monitor to see if Fox cable networks goes dark on November 1st.

News Corp.’s 38.4% stake in El Segundo-based DirecTV goes to former cable executive John Malone and his holding company Liberty Media Corp. Liberty also gets $550 million in cash and Fox’s regional cable sports networks in Seattle, Denver and Pittsburgh in exchange for its 16.3% equity stake in News Corp.

I will change my TV programing and go with another company. Even though my contract with Direct TV does not expire until 10/12. I will not continue with their services due to their breech of contract with me. Direct TV had better do something; I am positive I am not the only customer who feels this way. It would be a shame for Direct TV to have a mass exodus on or around Nov 30th. Listen to your customers, they have the right to have the programming they prescribed to.

I have been a faithful user of direct tv..I wrote direct tv & they say they will not carry some Fox programs such as Speed… well that the reason I got direct tv and I told them good bye, I meant it…. why loose all the good customers over such a small issue They will be the ones to loose $$$$$$$ in the end…Direct TV don’t do it….

I do not think that it is very fair. We signed contracts with D TV with the understanding that our channel line up included Fox/FX. I as well have discussed this issue with D TV whom also told me that I would have to pay an early termination fee. If they do not stick to their end of the bargin, why should we have to stick to ours? If D TV only signs onto channels for 1 year then why do they make us sign a 2 year contract. Our contracts should corrospond to their channel line up contracts. I will drop D TV if they drop FX and I will fight to get out from under the early termination fee…

Direct TV will lose over 1 million dollars of profit just from dropping fox channels. Sons of Anarchy fans will switch to other competitors just for that show. same thing happened with Comcast when they got rid of channels showing The Packers Football games. they lost over 100 million dollars of profit from their Wisconsin customers. I WILL NOT cancel over this…we can sit here and say this is Direct TV’s problem…but FOX did this to DISH Network last year. Why switch? They will do it again…why get mad at Direct TV for trying to keep a fair price not only for them but for their customers…why would cancelling programs be worse then them all of a sudden expecting you to pay more for it? If you weren’t upset about them cancelling you’d be upset about the upped charges…try to look at it in perspective…I love FX…I do not want to lose American Horror Story, but I also don’t want to bend to other people’s greed in this economy especially…I’m lucky to afford what I have, and I have no desire to pay more to support people whose wallets are already full.

i bought the NHL center ice package from direct tv paid for the whole season in full now with going on many of the games are delivered by fox sports stations, so they will not be shown, and the best part is direct tv will not credit the nhl package, no refunds. I have to say that I will have to cancell my direct tv account as well, FX and fox are two of the most watched channels for me and also i have nfl sunday ticket that isnt cheap, and there are many games on Fox, as well as just the point that when i signed up for a contract i chose my package for the channels I want.. For basic channels might as well go with DISH because they are cheaper anyway. I was a DISH customer for 6 years and switched to DIRECT, and looks like that ended up being a bad decision.

If I lose my sports viewing. I will also cancel Directtv. It’s already bad enough you can’t take care of your current customer’s. Just for me to update my DVR to HDDVR and still get it at no extra charge from my original agreement., I have to change carriers. So contiunue with this nonsense, it’s just like turning my power button off to DirectTv. Please reconsider your decision before you lose several customer’s to some other warm hearted service provider that will treat it customer’s right and not raise price’s.

Here we go again i had dish network switch to directv.One durring the st.louis blues hockey season in 2010 i was blackout of 35games that use to be on our local station KPLR Foxsports Midwest move those games to their station and wanted and extra fee to carried those games and dish network said no than in september of 2010 dish drop foxsports etc because the people at fox network wanted more money an also dish said i could lose my local fox station on oct1,2010 i had already lost haft of the hockey season that year and all the talked about losing blues hockey 2010-2011season&cardinals baseball in 2011 i got tire of all of this and switch to directv in in the middle of september 2010.Now i got to through this again this is a bunch of nosense the airways should be free fox programing & and other their programs are paid by advertisement when this started years ago congress should have said you can’t charged for programing if your channels are already paid for but if you don’t wan’t paid advertisement than you can charged liked HBO,SHOWTIME etc they are getting paid twice advertisement an us,I seen an ad tonight about i could lose the blues hockey season 2011-2012 & cardinals baseball in 2012 if that happens i am through with sports they can keep it if a lot of people feel liked i do nobody will watch an they will go out of buissness.

I just got off the phone with Direct-TV and told them I want to cancel my subscription. I am under a 2 year contract as some of you are. They simply said that I WILL have to pay the cancellation fee. When I said they broke the contract by taking channels away, they just said “The contract states that we can change channels at any time or change programming.” We can’t do a thing about the “contract”. I also had a problem from the beginning regarding HD local channels. I asked specifically about local HD and was told that I have it available to me. WRONG! They are having another running contract dispute with the local channels in my area. At least 50% of my viewing is on local channels and all they would do for me is give me free HD. After 2 weeks withe them, they started advertising “FREE” HD for everyone. All they did for me was take off the $10 monthly charge for HD with a monthly discount refunded back to my account. So I actually pay for it and then get the money as a discount…BUT STILL NO LOCAL HD. This has been a wake-up call. I WILL cancel this Direct-TV when my contract is up…..regardless if they keep the Fox channels. This also brought up a query, is Direct-TV a liberal organization???…Just asking…..

I’ve been a loyal Direc TV customer for 10+ years. I also pay a small fortune for their services. I have an HD contract now that if I leave I’ll probably have to pay but if I miss one episode of “Sons” this last season, I’m going to be pissed! Yes I can buy the DVD or pay to watch it on my computer but that’s not the point. I pay for those channels and should get them. I will never see 1 billion in my life time. Wouldn’t it be nice. Just one more way the big companies are sticking it to us. The 99ers make these people rich but do they care about us. No, they just want more money. Dish is starting to look pretty good!

I don’t care if they cancel Fox. I think that Fox is getting greedy. I don’t want to pay extra for a channel that I don’t watch everyday. I think Fox will lose alot of viewers if they don’t get realistic with their prices. Other shows and sports will start to move to other channels because they will lose money and they will prefer a channel/network with a wider audience.
There are different ways to catch your games. I personally like to listen to my Dodgers on the radio while I cook or in the car or go to a sports bar. As for SOA and AHS I can wait for the season to come out on DVD. It’s just T.V. I’ll watch TBS and TNT instead. There are like 300 Other channels.

I pay Direct TV $170.00 a month for their service so next month, if I lose 50% of the programing I watch, Direct TV will get 50% of the bill. It’s disputes like these that will continue to push more and more customers to internet TV and away from cable and satellite subscriptions. The costs are already prohibitive for many; neither company (Fox and DirectTV) should be putting their customers in this situation. In consumer business, customers don’t really care about or want to be involved in your vendor disputes; they just want YOU to deliver the service promised and if you can’t, you should compensate your customer. Ultimately, it shouldn’t be the customer that bears the impact (either less service or higher prices) because neither company (DirectTV or FOX) can compromise. Both should read up on Nexflick’s recent blunder to predict how their customer base might evaporate if these types of changes are pushed on us.

We have DTV only because of Fox Soccer. An attorney advised me that if DTV breaks it’s contract, then we are definitely not liable for paying ANY early termination fee. Fox had this same dispute with Dish last year. Now I am a year into a two year contract with Direct. Last year SOA, Nat Geo, went dark on Dish- there is no safe place from corporate coruption. You don’t care about the people who make it possible for you to exist. Really for me it boils down to a 40% increase for three shows; two of which are in the middle of the season. Once the network goes dark everyone loses due to egos, greed, & control.

I’m faced with a dilema. I absolutely do not like Direct TV. I think the service is terrible, I think the customer service is even worse. I’ve never dealt with such terrible people when it comes to issues. HOWEVER, I dislike everything about FOX as well. FOX news does nothing but instill fear among its viewers. NatGeo is a great channel, but I think I can do without it until either they sort this our or I cancel my DirectTV…which I do plan on doing, but now I will wait just so those greedy bastards won’t think they’ve won a battle. I’m not sure which other channels I will lose, but I’m sure I can live without them for a while. But, will direcrt tv lower their prices if they don’t offer the same number of channels? They should if they are into what is and isn’t fair.

This is really getting old. My question is. What if 4 or 5 contracts between Direct TV and different networks that provided bundled channels were up at the same time, and we were going to loose 80 or 90 channels or about half the decent programming that they provide, could they hold us to the contract if we were loosing half of our programming? Those HD/DVR receivers aren’t worth a thing to me or anyone else if the programming thats coming out of it is the Home Shopping Network or some stupid music channel. i will be contacting my congressman and senator regarding this to help me find a way out of my contract. i think if they were dropping a channel we would have a problem getting out of it, but a whole group of channels at least we should be able to get a reduced rate for the loosing of a complete group. i can understand Direct TV and what they are trying to do, but we also should have the same right to choose what we want. If they allowed us to choose individual channels to purchase instead of by the group. i bet they could save a lot of money by dumping about half the channels nobody watches. How many people watch the twenty or thirty info-mertial channels. Give it to the customers to decide and show them the prices per individual channel. If they want it they will pay for it if not somebody will loose and i bet it will be the networks.

Last night I sat down to figure out what we really watch on our DirecTV. What a shock! We watch a couple shows on cable channels one of which is Sons of Anarchy on FX and the rest are on the networks that I can get for free. This morning I ordered a strong outdoor antenna and have decided I can watch my cable shows on the net. I’ll save almost a hundred bucks a month and not have to go through this crap every couple of years with DirecTV. No more being held hostage by greedy corporate American cable/satellite companies. WOO HOO!

A big boost for the pay package though was an “up front” multi-year stock and stock options incentive grant valued at approximately $9.1 million per year over a three year period, the company said. “No additional stock-based grants are anticipated for Mr. White in 2011 and 2012,” the filing said.
Last year was White’s first at DirecTV.
The filing listed his base salary at $1.45 million. White also received a performance-based bonus of $4 million. The filing also mentioned the up-front stock awards valued at $14.7 million and option awards worth $12.5 million overall as part of his compensation, plus “other” compensation.”
Perhaps Direct TV should take another look at where their money is actually going. Compensate the customers…cut the CEO pay by 90% – 95%

Wake up and take a careful, blinders off look at Netflix – got a little (meaning a lot) greedy and now they are going down the tubes real fast. Yes, we have a contract with direct tv, however as the saying goes “you can’t get blood out of a stone”. All of us are quickly turning to stone. Quite frankly if I never watched Fox news again, with all the bickering and overtalk argueing on their talk shows, that would be just OK. I will protest over the loss of all the other programming that I went to Directtv for in the first place.
Corporate greed will make millions of viewers get off the couch and go back to playing sports instead of watching sports….maybe learn to read again…..maybe go to the movies more……maybe pay attention to their kids again……or just come out of the stupor of watching endless hours of tv.

What is going on here? Is Direct TV holding out for more reasonable prices because Fox is being greedy? Sounds to me like 40% is too high, so Fox needs to stop all this sillyness and come down in price. 40% increase in this economy is being greedy.
I’m with Direct TV on this one and will sacrifice being able to watch certain Fox programs on the principle of fairness. All those willing to switch are selling out to Fox’s greed, and in the process promoting the same type of greed we are seeing all over the country.
These big corporations know they can take advantage of us because too many people are unwilling to sacrifice and stick to principles, even for a short period.
Take a stand and say no to corporate greed by your willingness to sacrifice short term in the interest of the long term.

After seeing the message on the screen while watching a favorite show; I followed the web link to read their msg. Then I jumped over to my DirectTV account to read more. News Corp last year did the same BS with Dish Network and some other cable providers. Here is how I see it: I agree with DirectTV with not increasing the cost. Our economy crisis is killing the average people. Big corporations sit nice and cozy, while as we are struggling. Don’t get me wrong, I understand that contracts have come with some cost and stipulations. However what is the gain for News Corp? I watch 1 channel that is being interfered with (FX), I do enjoy the shows; however I will not pay additional 40% for 1 channel and a small handful of shows. When I called dtv I was told that I did not request one. I asked them to review the tape of my phone call,which I know are recorded,and they refused. Now that are threatening to take my favorite shows.that’s a breach of contract and I certainly will cancel. As far as the early termination fee,good luck collecting that!I have cancelled out the card the account was billed to. Up yours dtv!!

I have Fox Soccer at both home and office, and Fox Soccer Plus at my home. I currently pay DirectTV $14.95/month for Fox Soccer Plus at my home. Interestingly, when I learned these may be cut 11/1 I looked at my local cable option and found Fox Soccer Plus bundled with other programming for $6.95/month (not a sign-up special). So, who is gouging me pricewise — the program provider or DirectTV? It seems to be DirectTV!

I recently signed up for Direct TV. I made sure all of the channels that i watched were available before doing so. If Direct is going to drop a channel,then current contracts should be grandfathered in until the contract expires. This is the new thing in this country.Just like our government. They wait until the last minute before negotiations and then proclaim it a crisis. Its a way of both companys getting you to bend over and take it. Obviously contracts as large as these are not renegotiated a week before they are due to expire. Unfortunetly we are now sheep in this country. Now i have to gho watch my gas needle go down to empty. When my car stops i will proclaim it an unforseen crises.

i am not surprised tyipical corporate america so greedy. and i have had nothing but problems with the speed of my dvr recever you no those big ugly ones they send you. local cable companys will pay off your contract call them.

DTV keeps talking about 40%increase. My question is what are they paying for fox programs relative to the other three networks. Is it comparable or are they offering FOX 40%less than they are paying ABC, NBC and CBS.

I AGREE I WATCH MANY MANY OF THE SHOWS ON FOX SO I WILL, AS I BELIEVE OTHERS WILL TOO,DROP DIRECT AND SWITCH TO DISH NETWORK THE SAME DAY THEY DROP FOX IF THEWY HAVE 19 MILLION SUSCRIBERS IM ESTIMATING 40-50% DIRECT TV CUSTOMERS WILL SWITCH OVER AND THAT TO ME SOUNDS LIKE A MAJOR LOSS.

Everyone should drop direct tv…they broke our contracts by not providing fox….this is fraud…..I am sure the courts would find in our favor…..and if they try to make you pay cancellations charges take them to court….

Direct TV is used by a hugh number of households. Without FOX we will have to get our tv news from ONLY liberal sources. Could this be a manufactured dispute for the purpose of controlling what news the American people are exposed to, at this time just before election? 1am on Nov 1st, Direct TV, sends a message that the owner of the Fox channel requested to have the Fox channels removed from Direct TV lineup. Comcast (cable) has Fox. I think it is time to make a change.

We been with direct tv long time over 13 years. We pay for NFL channel u take the. Fox channels we take our cable business elsewhere. We rely on Fox for news and football. This is a loser decision Direct. Direct T V is a company that has a problem. I have a contract that has a price lock. I paid for the channels and if cost more for them to get them than that is the cost of doing business. Don’t expect me to pay more for a channel. I had this same problem with time warner the whole cable tv industery is a sham of bate and switch.

I fully intend to ask for a credit on my bill! My contract includes these channeis and if i’m not getting them, then dtv is in breach of contract. Therefore, should i decide to terminate, i won’t be paying any termination fees. I will also notify the fcc of this fraudelent practice!

Wow, here we go again. CEO’s wanting a bigger bonus payout at the expense of the Direct TV, DIsh TV, X-Finity etc. After all we all know who winds up paying for the increases, The Customers of these providers. We are NOT getting raises, and I know FOX 13 is not passing this windfall on to their employees so again the customers are paying for some rich CEO to get a bigger bonus, while my bill will go up to cover their bonus. I am so tired of these CEO’s etc. making over a million or more a year, get real do you know what we have to live on? We live on $20K to, if we are lucky, $40k a year so don’t be surprised if I am not crying, FOX 13 and the FOX Stations, a river and applaude DIrect TV for looking out for us.

well direct has already removed 17 of my channels and now can’t get fox sports.they have already broke the contract so when i cut then off i won’t owe them nothing.big company’s think they can screw you when they want to.i have no problem doing without them and everyone should just dump them.then what would they do?

I’m so sick of them taking crap away, we pay over 200 per month I want every freaking channel. My husband is getting that stupid NFL package, but because the game is on a regular channel he can’t watch it. I’m so over this. Sit down and come up with a compromise. I work hard everyday, I work the night shift and I went to direct tv for several reason one being I could record my favorite shows and them watch themwhen I got off work unfortunately several of my most favorite shows are on channel 18. I find this to be very upsetting I work at a very stressful place and being able to relax when I get home is very important and now I will be missing out on that because of this situation. I don’t know where all the blame is but direct tv needs to fix this or u will end up losing a lot of your customers all because of money ( what a shame)
